CoMSO submit memo to Prime Minister  Mr Modi  to implement ILP in Meghalaya

Shillong, Nov 03: The NGOs from Meghalaya under the banner Confederation of Meghalaya Social Organization, today has submitted memorandum to the Prime Minister  Mr Narendra Modi urging him to implement Inner Line Permit in the state of Meghalaya.

In the memorandum  CoMSO would like to take this opportunity to  to inform you that CoMSO was formed by the Civil Society Organisations of the State of Meghalaya both from Khasi-Jaintia and Garo Hills regions.

Its main objectives is to strive towards protection and promotion of the aspirations of the Indigenous people of the State as well as to work for the protection of the Land, Natural resources, Cultural Heritages and Languages of our State.

Hence, CoMSO stands united to demand for legislations to protect the very existence and welfare of the indigenous People of the State. That, Four States in the North Eastern part of India have put in place laws and mechanisms to contain unregulated entry of people into their States by implementing the Inner Line Permit (ILP) System.

This was an offshoot of the ‘Bengal Eastern Frontier Regulation Act 1873’. However, our State, which have been demanding ILP for a very long time have been denied this law and mechanism by the Central Government.

That, the Meghalaya Legislative Assembly on the 19th of December, 2019 had unanimously adopted a Resolution urging the Government of India to implement ILP in the State under the Bengal Eastern Frontier Regulation Act 1873’.

 The said Resolution was moved by the Chief Minister Conrad K Sangma and all members across party lines, including the MLAs of the BJP, supported it. The Assembly Session for One day only was held for the sole purpose of passing the above Resolution as it is the aspirations of the indigenous people of State to implement ILP.

That, the Union Home Minister Shri Amit Shah in his Meetings with the delegations of the State led by our Chief Minister Shri Conrad K Sangma, in the month of February, 2020 has assured that the Government of India is examining the matter for implementation of ILP in the State.

However Sir, the said Resolution was passed and forwarded to the Central Government in the month of December, 2019 and as per statements of our Chief Minister recently, it is learnt that the Centre is still examining the issue till date.

That Sir, as per the Reply of the Hon’ble Minister of State for Home Affairs in the Rajya Sabha on 27th February, 2013 relating to implementation of ILP in other States of the North East pertaining to the question asked by the Member of the Upper House, Shri Sabir Ali, MP.

It is abundantly clear that ILP is a system specially meant for the protection of the Indigenous/tribal population in these States and also made it clear that ILP system falls within the Reasonable restriction of Article 19 (5) of the Constitution of India.

That Sir, the Hon’ble Gauhati High Court in the case of “North East Plains People Traders and Youth Federation v. Union of India, 2008(3) Gua LT 845” has also upheld the validity and constitutionality of the Bengal Eastern Frontier Regulation, 1873.

That Sir, Meghalaya just like Mizoram, Nagaland, Arunachal Pradesh and Manipur is a small state where the indigenous people of the State are minority in the context of national population and thus it need special protection just like the indigenous people of the other four States referred to above.

CoMSO are of the opinion that Meghalaya being the transit State to other North Eastern States, flexible Rules maybe framed by the State Government to implement ILP system so that persons using the State as transit purpose only will not be affected.

Based on the above facts and circumstances, it humbly requested that your good office to kindly accord approval for implementation of ILP system in the State of Meghalaya. At the outset, the undersigned on behalf of the Confederation of Meghalaya Social Organisations (CoMSO) would like to take this opportunity to

As such, CoMSO is pleased to place before your good office the following points for your kind and considerate actions:

 

  1.
