NEHU declare the new Executive Committee of NEHUTA 2020-21 is null and void

Shillong, June 19: The North-Eastern Hill University would like to apprise the general public and to clarify on several allegations that have been levelled by the North-Eastern Hill University Teachers’ Association (NEHUTA).

According to the NEHUTA Constitution, the Association has an Executive Committee with 11 members including office bearers namely the President, Vice President, General Secretary, Joint Secretary, Treasurer, elected annually by the members.

The term of the Executive Committee (2019-2020) has already expired early May, 2020 in accordance with the Clause 8 of the Constitution of NEHUTA. Further, regarding the Election Committee, Regulation 2 of NEHUTA Constitution provides for the Conduct of Election.

“2(i) The Executive Committee shall recommend constitution of an Election Committee of five members including the Convener and present the same to the General Body of the Association in its first meeting for its Consideration and approval. The Election Committee shall be notified after approval of the General Body.

The Election Committee shall be responsible for conducting Elections to any vacancy that may arise during the year and also the new Executive Committee that shall have to be constituted at the end of the term of the incumbent Executive Committee.”

It may be mentioned that despite being aware that NEHUTA’s Executive Committee’s term was over (including that of the President and General Secretary etc), both the ex-President Prof. X.P. Mao and ex-General Secretary Dr. M.M. Khymdeit continued to sign and quote themselves purportedly as President and General Secretary.

The NEHUTA in all notifications or representations and letters to the University, the media and others from mid-May till date. This is tantamount to manipulation and also violation of the NEHUTA Constitution.

It may be pointed out that NEHUTA Constitution cannot override the NEHU Act and Statute, and the NEHUTA Constitution is subservient to the NEHU Act. According to Statute 44 of the NEHU Act and Statute, the Teachers’ Association has been established and its functions should be in accordance with the provisions of said Statute 44.

Hence, the Election Committee notified dated 29th May, 2020  is unconstitutional and the election of the new Executive Committee of NEHUTA 2020-21 is null and void. The NEHUTA should ensure that the next Executive Committee should be constituted and the election process should be conducted, strictly in accordance with the NEHUTA Constitution.

As regards to NEHUTA’s Annual Grant (2018-19 and 2019-20), the University has withheld the same because the teachers’ body had given a boycott call to the XXV Convocation held on 28th November, 2018 wherein the  Governor of Meghalaya and Chief Minister of Meghalaya were the Chief Guest and Guest of Honour, respectively and the Convocation ceremony is meant for our graduating students.

Further, NEHUTA has not submitted the list of members who had given the boycott call, despite several reminders which is required by the University authorities before any decision can be taken regarding Annual Grant keeping in view NEHU Statutes and rules.

NEHUTA being an Employees’ Association established under the Statute 44 of the NEHU Acts & Statutes has violated the Statute 44 (3), by giving the Convocation boycott call. Also, the NEHU Ordinance OC-10 on “Convocation procedure” has been violated by the Teachers’ Association as the Academic Council members are required to be present and walk in procession during Convocation.

From the above, it is evident that the NEHUTA has been indulging in activities which have deeply hurt the image of a premier institution like NEHU and in complete violation of NEHU Statute 44 (3) that states that “No association shall act in any manner whatsoever which may bring down the image of the University and which may be detrimental to the achievements of the objectives of the University laid down under the North-Eastern Hill University Act, 1973”.’  Further, the NEHU Acts and Statutes also provides for de-recognition of Association.

In certain timely administrative actions like temporary removal of the heads of two departments viz. English and Political Science has been carried out due to non-compliance of directions of MHRD, Government of India and University regarding submission of completed reports for online classes in the prescribed format.

In the functioning of the University regarding all administrative and academic or financial matters, the University has been following the relevant provisions of acts and statutes of Government of India rules and regulations and GFR, etc.
