Shillong, August 08: Hearing of Special Leave Application No: 19617/2013 filed by the CMJ Foundation in the Hon’ble Supreme Court of India was taken up on 2nd August 2013.Senior Advocate Dr. Abhishek Manu Singhvi appeared on behalf of the Petitioner CMJ Foundation. Hon’ble Supreme Court has directed the Counsel of the Governor to produce all the documents in original pertaining to the correspondence made in respect of the appointment of the Chancellor of the C M J University.
It was alleged by the Senior Advocate Dr. Singhvi that the action of the former Governor Mr. R S Mooshahary as a Visitor of the CMJ University was a grave mistake, while directing the CMJ University to cancel/withdraw/revoke all the Degrees, Diplomas and certificates awarded by it. He further added that the former Governor/Visitor of the University had gone beyond his jurisdiction and his direction to the University is an attempt to ruin the future of thousands of the Students and it was not in the interest of the student community.
Before the Hon’ble Supreme Court of India, the issue of appointment of Chancellor and his approval was raised. It was stated by the Learned Senior Advocate on behalf of the CMJ University that as per the provisions of the CMJ University Act 2009 the duty to appoint the Chancellor of the University was solely upon the CMJ Foundation who is the sponsor of the University and accordingly it had appointed Mr. C M Jha as its Chancellor with due procedure of Law and the Governor of Meghalaya being ex-officio Visitor of the University was required to approve the said appointment of Chancellor.
It was alleged by the University that the Former Governor of Meghalaya being ex-officio Visitor did not approve the appointment of Chancellor of the University for last 3 and half years and kept the matter pending without any justifiable reason for the reasons best known to him most illegally. Hon’ble Supreme Court has directed the Counsel of the Governor to produce all the documents in original pertaining to the correspondence made in respect of the appointment of the Chancellor of the C M J University.
Since the University has been sealed by the Police, the Superintendent of Police has been directed to supply the Copies of all the documents to the University authorities. The Hon’ble Apex Court has fixed 22/08/13 as next date for hearing. (SP News)
