HSPDP seeking disqualification the MLA of Pariong

Shillong, January 15: The parent  party HSPDP has seek the disqualification of Dr Adviser Pariang from the Speaker of the Meghalaya Legislative Assembly, on the ground that he is elected from the HSPDP Ticket and without resigning from the party his name appears as Congress Candidate that will be contesting in the 23 February Election.

That Dr.  Adviser  Pariong  was  elected  MLA  in  February,  2008  from  the  erstwhile  Pariong  Constituency  as  a  candidate  of  the  HSPDP  securing 8225 votes.

That  for  the  2013  State  elections,  he  has  been  fielded  by  the  Congress  Party  as  its  candidate  from  the  Nongstoin  Constituency  without   having  resigned  from  the  HSPDP   and  which  candidature  became  known  to  the  Party  only from  newspaper  reports.

That  his  letter  of  resignation  from  primary  membership  of  the  HSPDP  was  received  by  the  Party  President  only  on 10/01/2013  though  it  is  dated  04/01/2013

2 (1)  (a)  of  the  Tenth  Schedule  to  the  Constitution  of  India    [Articles  102 (2)  and  191  (2)  of  the  Constitution)]  states  thus:

“Disqualification on ground  of  defection.  –  (1)  Subject  to  the    provisions  of  paragraphs  4  and  5,  a  member  of  a  House  belonging  to  any  political  party  shall  be  disqualified  for  being  a  member  of  the  House.(SP News)
