Shillong, Dec 09: The Civil Society Women Organisation (CSWO) today submitted a memorandum to the governor of Meghalaya Dr K K Paul seeking his internvention to remove P Naik from the post of Principal Secretary Urban Affair department, T Lyngwa as Secretary MUDA and advocate SP Mahnata as legal Councel.
The Memorandum of the CSWO read, I am desired to bring it to your notice on behalf of C.S.W.O, in the interest of the villagers residing in and around Umsawli, (Mawpat), Mawtari (Mawlong), that recently through various RTI’s applied we have come to find out, that due to the intention of the government to create a New Shillong Township, in those areas, land documents have been forged and manufactured for the purpose of cheating the Government and driving the real owners, of Umsawli, Mawtari(Mawlong) village, East Khasi Hills District, out of their own land.
The poor villagers are generally, depending mainly on agriculture, and are being forcefully evicted from their homes and their lands being grabbed by Government, through interested persons who have no right in the particular land. Due to their illiteracy, these villagers cannot protect their interest.
We have sufficient document to prima facie show that the people who sold their land to the Government have forged & manufactured the document with exaggerated boundaries to dupe the Government to the tune of more than 10 crores and in the process got the Government to oust the innocent and helpless villagers.
We would like to remind you that on the 8.11.2013, 5 houses 2 cowshed and 2 shops were demolished by the MUDA on the instruction of the Secretary MUDA T Lyngwa. The same demolition drive was carried on in 2012 where 4 houses were demolished, even though the people had been staying there for decades and also had registered land documents.
The land in question is claimed by Unikey Kharkongor and Nearly Kharkongor, who sold the land to MUDA measuring an area of about 285 acres out of the 2372 acres. But strangely enough, the document of that land is full of doubt on various counts;
The deed of declaration is not supported by any valid title of the said land. The boundaries too were not specified in measurements.
The stamp paper date is later than the executed date that is the document is executed on 4.6.1992 and the stamp paper was bought on the 5.6.1992. (It may also be mentioned that the back of the first page of the stamp paper wherein this forgery is visible was dated 5.6.1992, while the Judicial Magistrate first Class signed on the document in the front page, and put the date as 4.6.1992).
The important fact to be noted is that Shri SP Mahanta makes/prepares the said declaration deed and gets it registered. So Shri S P Mahanta is an interested party in the case as he makes the deed for Unikey and Nearly Kharkongor.
Of all the people (Advocates) Shri SP Mahanta gets appointed on temporary basis to facilitate the sale of the said land for whom he made the deed of Declaration.
When an FIR was filed against them (the Land owners Unikey Kharkongor and Nearly Kharkongor) though Shri SP Mahanta was the legal Counsel for MUDA , he goes out of his way to help them by moving anticipatory bail for them, and regularizing the bail. It appears that the Adv SP Mahanta is working for the interest of the ladies more than for the interest of the MUDA.
It may also be mentioned that couple of year’s back Shri SP Mahanta had met the Umsawli and Mawtari Land owners and had told them that it was no use to fight as the land of the two ladies were supported by old documents. He has misled these villagers who refused to obliged to his pressure tactics.
Moreover, though SP Mahanata is an interested party as he was advocate for Smt Unikey Khqarkongor and Nearly Kharkongor who are claiming to be the joint owners of the plot of land measuring 2372 acres, and had helped in executing the deed of declaration which was not supported by any valid title, and also appears to be tampered, he is still being asked by the MUDA to represent them which is against legal ethics.
The RTI from the DC (Rev) also reveals that the second page of the land document was incomplete. With this revelation we filed an F.I.R in 2012 specific date being 9.4.2012,( Sadar PS case No 83(5)2012, u/s 420, 468 IPC, and had written to the Secretary MUDA informing him and seeking to verify the documents. As a State Government authority, the Secretary should have taken seriously the information wherein Government stands to lose, as it is clear that any transaction based on forged document, becomes null and void as per law.
