The DC West Jaintia Hills order for closure of Lime stone mining in Amlarem

 

Shillong, June 9: The Deputy Commissioner of West Jiantia Hills District has promulgate  section 144 CrPC in the entired area of  Amlarem Civil Sub Division where lime stone mining activities taken place.

The reason that the Deputy Commissioner of West Jiantia Hills District for promulgating  section 144 CrPC for the closure of mining activities  are being operated without any legal sanction from the competent authorities, thereby, violating all environmental laws, and clearances,  whereas, such illegal mining activities have also brought  Destruction  to the National Highway 40 (E), besides, using of blasting for mining purpose  beyond permissible limit.

These has caused a threat to commuters on the said National Highway, And, whereas, Sub-Divisional Officer (Civil) has also submitted his compliance Report dated 5.6.2013 on the matter after an inquiry was conducted in his report the SDO (civil) had mentioned that the mines operators and the decision there on where willful and blatant violation of such decision by mine operators.

And also  a complaint dated 03.06.2013 has been received from the chairman and secretary of Banan locality, Nongtalang, under Arnlarem Civil Sub Division that rampant limestone mining activities where taking place in the areas which have resulted to pollution of water bodies and natural sources at Amdap, Am keajing, Am Sohmahaleng, Am Doloi, Wan Latyrngui, Am Khlew, Am Tren, Am Tuma, Wah Amdohkha, Am Lyngphung, Am Hynshyai Duwar, Am Kru, Am Khruk Khruk, Am Ho, Am Tkhiang, Am Sngai Daloi, Am Sohpiang.

The areas affected include the villages of Nongtalang and Amtapohunder Amlarem unit Sub-Division. Limestone mining activities have gone beyond any permissible limit and without any restriction.

Such mining activities are found to have been operated without any legal sanction which includes environmental clearance. Mining operations have caused damage to perennial springs and natural sources of water which is a lifeline to villages of Nongtalang and adjoining areas. I The National Highway 40(E) has been damaged resulting to massive  pollution, traffic jams. Using of explosives without proper regulation has been a threat to commuters and passers- by. The DC said that he was  satisfied that, prima facie, there has been a massive destruction and illegal mining activities of limestone flouting all environmental laws and, thereby. violating all provisions prescribed under the said law.

“I am also satisfied that the operations have carried out without valid licenses under the Mines and Minerals( Development and Regulations) Act, 1957, Minerals Concession Rules, 1960 which infringes the spirit of all Rulings of the Honble Supreme Court in this matter”.

The  District Magistrate, West Jaintia Hilk, in exercise -of the powers conferred U/S 144Cr.P  do hereby direct that all the illegal mining operations at Nongtalang and Amtapoh Villages of Amlarem unit Sub-Division shall forthwith be stopped .The operations shall be subjected to regulations bycompetent authorities.(SP News)
