The DC of WGH district promulgate MMOPO, Autonomous District ACT, 1953

Shillong, April 03: The Deputy Commissioner of West Garo Hills District promulgated under section 163 BNSS 2023, read with section 8, 8A and 9 of the Meghalaya Maintenance of Public order (Autonomous District) ACT, 1953 (As adapted by Meghalaya.

In the notification No.CB.1/2026/54:- Whereas, this office had earlier promulgated an order vide  No.CB.1/2026/53, dated 16th March, 2026 under Section 163 of the Bharatiya Nagarik Suraksha  Sanhita, 2023, read with Sections 8, 8A and 9 of the Meghalaya Maintenance of Public Order  (Autonomous District) Act, 1953, as adapted by the State of Meghalaya.

The Deputy Commissioner imposing certain restrictions within the jurisdiction of West Garo Hills District with a view to preventing breach of peace and maintaining public order and tranquility; And whereas, reports, situation assessments, and intelligence inputs received from the Superintendent of Police, West Garo Hills, Tura and other law enforcement agencies, and duly placed before me, reveal that although overt incidents of disturbance have presently subsided.

The situation continues to remain sensitive and potentially volatile, with a reasonable apprehension of  recurrence of activities prejudicial to public order and tranquility;  And whereas, the DC have carefully examined the said reports and material on record and upon  due application of my independent mind to the facts and circumstances of the case.

The DC, have arrived at his  considered satisfaction;  And whereas, the DC satisfied that there exists sufficient grounds for proceeding under Section 163 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and that immediate prevention and  speedy remedy are necessary to avert any imminent danger to public peace, safety, and  tranquility.

To prevent obstruction, annoyance, or injury to persons lawfully employed, and to safeguard human life and property;  And whereas, I am further satisfied that the circumstances are such that they do not admit  of serving prior notice upon the persons likely to be affected, and that this order is required to be passed ex parte in the larger interest of maintaining public order.

Now, therefore, “I, Shri Vibhor Agarwal, IAS, District Magistrate and  Deputy  Commissioner, West Garo Hills District, in exercise of the powers conferred upon me under  Section 163 of the Bharatiya Nagarik Suraksha Sanhita, 2023, read with Sections 8, 8A and 9 of  the Meghalaya Maintenance of Public Order (Autonomous District) Act, 1953, as adapted, and in  view of the facts and circumstances stated hereinabove, do hereby pass the following Order:

Extension of Earlier Order , The prohibitory order vide No.CB.1/2026/53, dated 16th March, 2026 issued by this  office shall remain in force for a further period of two (2) weeks from the date of its  expiry, unless withdrawn earlier.

Continuity of Restrictions , All directions, prohibitions, restrictions, liabilities, penal provisions, enforcement  measures, and exemptions contained in the aforesaid order shall continue to operate in  full force and effect during the extended period and shall be deemed to have incorporated  herein.

Binding Effect, This order shall be binding on all persons, groups, associations, and organizations within  the jurisdiction of West Garo Hills District.

Enforcement,  The Superintendent of Police, Executive Magistrates, and all Police Officers are hereby  directed to ensure strict implementation and enforcement of this order. They shall take all necessary lawful measures to prevent violations and maintain public order and tranquility.

Consequences of Violation , Any person contravening this order shall be liable for prosecution and penal action in  accordance with the provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023, the  Meghalaya Maintenance of Public Order (Autonomous District) Act, 1953, as adapted,  and other applicable laws in force, and shall also be liable to compensation for any loss or  damage caused.

Review and Modification, This order shall remain subject to periodic review and may be modified, relaxed, or  rescinded at any time depending upon the assessment of the prevailing law and order situation.

Commencement and Validity , This order shall come into force immediately upon expiry of the earlier order vide No.CB.1/2026/53, dated 16th March, 2026, and shall remain in force for a period of two weeks thereafter, unless withdrawn earlier. Given under his hand and seal on this 31st day of March, 2026.
