Shillong, May 17: The Chief Justice of the Shillong High Court today passes an order that the CMJ University should not admit student until the controversy resolved. With this order the case was disposed off.
In the order the court finds that the letter of the governor as contain 30.04.2013 has no legal infirmity and need not to be interfered by the Court. It is also made clear that till the controversy is resolved the university shall not admit the students in the University.
The case was file by the CMJ Foundation against the state government. The write petition that file by the foundation against the state government is questioning the order pass by the Principal Secretary to the governor of Meghalaya.
In the letter certain direction were issued purported to be one under section 13(3)(b) of the CMJ University Act, 2009. The controversy aroused with regard to the appointment of chancellor of the University, plead the learned counsel SP Sharma who appear on behalf of the foundation.
The learned advocate general, Meghalaya who appear on behalf of the government contended that the governor secretariat has complied with the provision of law by issuing prior notice to the university seeking information.
The advocate general the admitted fact there was no approval accorded for appointment of the chancellor of the university and the governor secretariat was right to direct the university to recall and with draw the university degrees.
It is observed that the university has acted on its own with out getting approval of the appointment of the chancellor in admitting students commencing from 2010-11. It is a common policy that the University cannot confer degree on a student with out a chancellor of the university. (SP News)
