Shillong, August 08: The CSWO would like to point out that during the High Level Committee (HLC) meet the NGO’s, had repeatedly asked for the copy of Repealing Act 1897, but till date we have not seen the actual repealing Act 1897.
This repealing Act does not exist in paper because if it did the Legal experts should have produced the same to the HLC. It was stressed upon, time and again, for it to be shown to us, but the Advocate General and the Law Department could not produce the same.
The portion added in the Footnotes of the Regulation 5 of 1873, (Bengal Eastern Frontier Regulation act 1873) , which is in the website of the Ministry of DONER, cannot be a fact, if there is no original from which it was extracted.
This footnote is available in the website of the Ministry of Doner…This very Ministry, has strangely ordered for maps to be printed of the North eastern States, in 2009, knowing fully well that there is a boundary dispute between Meghalaya and Assam. This ministry is also having in its website the Regulation 5 of 1873, (Bengal Eastern Frontier Regulation 1873)
Wherein it is mentioned in footnotes that Garo Hills Districts, was repealed by the Repealing Act, 1897 (V of 1897). Many reproductions are being inserted and manipulated allege CSWO president in the press statement, and as in New Delhi, where Coalgate Scams are missing, here in Meghalaya too Land Files, land records are not available.
A whole file related to land amendments in 1979, is missing from the law department and an amendment was inserted in 1979, which seems not to have been actually amended in the Assembly, and it states as follows; Nothing contained in this Act shall apply to- (d) any transfer of land to, or in favour of, (i) any company, corporation, society (including co-operative society), autonomous body or association, wholly or substantially owned and controlled or managed by the Government and which the Government of Meghalaya may, by Notification, specify in this behalf;(ii) a Municipal corporation, municipality or, town committee constitutedunder any law There were Amendments of the Land Laws that are being inserted, when there was no actual amendment made, and the President’s assent was not sought, especially when it involves land issues and directly conflicting with the Sixth Schedule. This seems to be a serious fraud on the Indigenous Khasi, Jaintia and Garo people and the Legislators should take this up in the floor of the House questioning the missing files and missing documents related to land.
The Legislators should also ask for the copy of the original Repealing Act from the Government. Unaware of what is happening to many, the State of Meghalaya is being silently demolished. Agnes Kharshiing President CSWO.(SP News)
