Mr. Flaming urged Eeducation Minister to appoint contractual teachers  who passed MTET

Shillong, April 05:  Mr. Flaming B. Marak District Secretary Youth Human  Rights and Anti-Corruption Youth Power of India, today has written to the Minister Incharge  education Government of Meghalaya to appoint all thus contractual teachers who has passed the MTET examination  as per the High Court order.

“That in the light of the mandatory provision of Right To Education Act, 2009, the NCTE (National Council for Teachers Education) notification had been issued by the Department of School Education and  Literacy, Ministry of Human Resources Development, Government of India on 29.07.2011.

In compliance the state of Meghalaya was bound to conduct the MTET examination and include it as necessary qualification for eligibility for appointment of teachers at lower and pre level schools in the entire state of Meghalaya and accordingly for the first time the MTET was conducted on 31.01.2019 for appointment to all the primary teachers in the state of Meghalaya and the result was declared on 25.02.2020.

It may be stated that being aggrieved by the MTET exam conducted by state of Meghalaya, the group of teachers from entire districts of Meghalaya have approached and filed the writ petitions i.e WP(C) No. 98, 99, 101, 102 , 103, 146, 147, 148,  149, 150 and 193 of 2020.

The  High Court of Meghalaya in vide order dated.05.10.2020 have dismissed the writ petitions on the ground that  the NCTE (National Council for Teachers Education) issued by  Education & Literacy, Ministry of Human Resources Development, Government of India on 29.07.2011 is mandatory statutory provision whereby the teachers  ought to have acquired the essential qualification namely MTET.

It is in the light of  NCTE issued by the Government of Meghalaya and in the light of the High Court order dated.05.10.2020, about 2000 contractual teachers of entire of state of Meghalaya  were terminated and removed from their service with an aim to appoint the candidate who have cleared the MTET.

It is pertinent to mention herein that there are number of MTET passed candidates waiting for the appointment but surprisingly till date number of MTET passed candidates are still yet to be appointed.

That it appears on last Assembly Budget Session, the minister incahrge Education Department  have informed the house that total of 1200 temporary teachers will be appointed immediately.

In his respect it is beg to submit that appointment of 1200 temporary teachers will amount the violation of NCTE norms issued by the Government of India and it will be against the High Court order dated.05.10.2022 passed in WP(C) No. 98, 99, 101, 102, 103, 146, 147, 148, 149, 150 and 193 of 2020.

Human Rights and Anti-Corruption Youth Power of India request  the minister incharge eduction to strictly adhere to the existing provision particularly to follow  the mandatory provision of Right to Education Act, 2009.

The NCTE Act and notification and guidelines and also the High Court order dated.05.10.2022 passed by the High Court of Meghalaya  while appointing the teachers particularly making an appeal to give priority to the MTET candidate who are still waiting for their regular appointment for the interest of the state and  for the interest of justice.”
