Shillong, December 28: The CSWO strongly condemns the acts of sexual exploitation of a minor girl by an MLA of the State of Meghalaya and lauds the action of the Chairperson State Commission for Protection of Child Rights, (SCPCR) who has done the right thing to protect the child from even influential persons.
No one is above the law and this should teach a lesson to those who are thinking they can take and induce minor girls for their sexual satisfaction. The CSWO demands the immediate arrests of the MLA as the law is equal for everyone and no bail should be granted according to POCSO and urge the Police to follow the Act to its totality.
This girl was sexually exploited in various Hotels and guest houses according to FIR filed by her on the 16th Dec 2016 and on further recollection one such is the guest house in Motinagar where she was taken to one MLA whom she had named in the statement to the Chairperson SCPCR too.
She had also mentioned the incident to the IO of the Madanrtyting case who we fail to understand why she kept quiet and did not act on the Statement given by the victim girl. The FIR cannot contain the whole incidents of what happened to the girl as she has been exploited in many places by many men. Not invoking section 16-17 of the POCSO Act to Mamuni by the Madanryting Police in itself indicates that she is being helped to protect those connected with her.
Many names have been revealed to the IO at Madanryting by the victim in her statement but no action is being taken and the Chairperson had to take action to file the separate FIR mentioning the relevance of the Madanryting case.
In Section 16 of the POCSO act ‘a person abets an offence, who- intentionally aids, by any act or illegal omission, the doing of that offense’, and in explanation it is clearly mentioned that ‘Whoever, either prior to or at the time of the commission of an act, does anything in order to facilitate the commission of that act, and thereby facilitates the commission thereof, is said to aid the doing of that act’.
Further Section 17 of the POCSO act provides for Punishment for abetment and according to that section, ‘whoever abets any offence under this act, if the act abetted is committed in consequence of the abetment, shall be punished with punishment provided for that offence’
Mamuni Parveen with whom the girl has been staying for about a year, has lazed the drinks like a juice and had given to the minor girl before she took her to the guest house at Motinagar where the MLA was, and this itself attracts section 16 and 17 of the POCSO Act.
The girl has clearly pointed out the photo of the MLA even to the Police, identifying him from a group of other men in the photo and when asked how she recognized him she stated that she had been taken to him twice, once to a different place. This is a minor girl and not a one who can fabricate such a situation and what political ambition would she have?
The Marvelene’s Inn too had no CCTV functioning for 15 days giving a chance for a man to sexually exploit a child, which again leads to abetment and licence of these guest houses should be cancelled instantly and the Home Minister should step down immediately as the Hotel belongs to his immediate family run by his wife. It is shocking that the Government is not taking any action in this regard to remove him from the post of Home Minister.
An immediate check of all Guest Houses and policy formulated to protect children from being exploited in them is a must. The Organization is getting information of few more such MLAs who demand for minor-under aged virgin girls and the racket to exploit children is thriving wherein some Legislators encourage the pimps and pay them heavily, thereby creating the demand and using some corrupt law enforcers to protect them.
The CSWO therefore urges the authorities to take the case of trafficking and sexual exploitation of children seriously and not to try to protect and shield the perpetrators and anyone trying anything out of hand will be booked for abetment said Smti Agnes Kharshiing President CSWO
