Shillong ,July 15: The Office of the Jaintia Durbar has ritten to the Chairman of the National Green Tribunal New Delhi, informing that the band on coal mining has affected the livelihood of the people in Jaintia Hills and in the state as a whole.
That as per land contour , topography and geography, residue and Influents , if, any from coal mining carried out in West Jaintia Hills District do not flow effect land and people of Dima Hasao District in Assam . Instead negative impact would be felt by Bangladesh particularly, with the setting up and running of nine cement factories in area of some 9 sq km in East Jaintia Hills.
That mining of coal in East Jaintia Hillsis traditional and follows the underground of system mining and not to open caste which to our findings and experience that former, system , process type is comparatively better environment friendly than the better system ,process, type . Further explanation would be necessary except to refers to prof. Priya ranjan Trivedi Internatiponal encyclopedia of ecology and environment , vol, 3 pp223, therefore mining per se , is not unsciencetific.
That Land Holding system in East JAintia Hills and for that matter in the whole of the Meghalaya state I,e 95% of land is of varying type where land own by the government is only 5 percent and acquisition , disposal etc, are govern by the provision of the VIth schedule to the constitution of India and the Meghlaya Land transfer act , as majority of the land is privately land , its utilization is a per following of tradition and customary norms beginning with no objection certificate issued by village durbar Authority and then upward , there it is not illegal.
That the land owner and majority of the miners have small land and holding followed and having followed norms and mention in 03. Is no such things as “coal mafia” but the miner are small, marginal and small adhere to specification and prescription for the process of mining thogh in the erae of deposit , dopots , thre were no direction issued by the authority except in a few village. Further, the issue of seeking mining lease as per from 1 does not arise while FORM B may be required if suitable review and improve upon.
That it is surprising band on coal mining in east Jaintia Hills has benn order while in ajecent Karbi Anglong Disdtrict (Actually dispute area between Meghlaya and assam)
Near the border of Dimma Hasao district, mining of coal is taking place on a rampant scale.
As a stated in afore mention, particularly in para 1 and subseguent paras , we shall remain ever grateful for the tribunal to review its earlier order on the said band and allow mining to continue as before with certain stipulation on being environment friendly but not to encourage setting up of large mining at the expense of livelihood and economy of the small and marginal miners and casual labour.(SP News)
