Yes the police have inform me that the MLA from Mawhati was arrested: Mandal

Shillong, January 08:  The office of the Assembly Secretariat has received the official information from the police department that Mr Julius Dorphang the MLA from Mawhati was arrested by the police.

Speaking to SP News Agency over phone the Speaker of the Meghalaya Legislative Assembly Mr A T Mandal said “ Yes the police have inform me about the arrest of the Independent MLA from Mawhati Mr Julius Dorphang was arrested by the Police”.

When asked whether  he (Mr Julius) will be disqualified the speaker said that for the disqualification of a members the house has to follow the Rules of procedure and conduct of business in the Meghalaya Legislative Assembly of Rule 185 (1).

This rule said,185 clause(1) said,  the seat of a member shall be declared vacant under clause (4)  of the article 190 of the constitution on a motion by the leader of the house or by such members to whom he may delegates his functions in his behalf .

And Cause (2) said, if the motion refer to in sub-clause (1) is carried, the secretary shall cause the information to be published in the official Gazette and shall forward a copy of the notification to the governor and the election commission.

Under Clause (4) of the article 190 of the constitution, said that, if for a period of sixty days a member of a House of the Legislature of a state is without permission of the House absent from all meetings thereof, the house may declear his seat vacant.

Provided that in computing   the said period of sixty days no account shall be taken of any period during which the house is prorogued or is adjourned for more than four consecutive days.

This are the rule that the house has to follow to disqualified a member of the house or till the court convict it. With the case of  Mr  Julius Dorphang  the police have arrested him.
