Shillong, February 03: The Meghalaya BJP state Unit demand that the Chief Minister Dr Mukul Sangma should step down after the Supreme Court ruling clearly said that the post of MDC is not an Office of profit. This show that the government has pass a faulty bills to become an Act and this is an attempt to do away with the District council.
Addressing media person at the BJP office, the President of the BJP Mr Shibun Lyngdoh and the General secretary Mr David Kharsati alleged that the Chief Minister introduce the bill The Prevention of Disqualification (Members of Legislative Assembly, Meghalaya) (Amendment) Act, 2015 was passed by the Congress led MUA-II state government in the Assembly win an intention to do away with the District Council.
But thank to the Mr PN Syiem the CEM of the KHADC who challenge in the court of law where the supreme Court clearly said that in the ruling that the post of an MDC is not an office of profit, with this ruling the act passed by the Meghalaya Legislature has become null and void, claim the BJP Leader.
By passing this Act the legislators who are also members of the District Council, resign where they have to conduct by election to the seven MDCs Constituencies at the cost of the public exchanger at the cost of more than two cores, who will bear to the losses from the plunder committed by the Government of Dr Mukul Sangma.
The BJP state general secretary David Kharsati said, felt that Dr Mukul Sangma should resign as he has failed in bring such legislation, he said Court is to interpret the laws pass by the Legislature and not to do away with, but in this case the court has override the law pass by the legislature, the Chief Minister has to take the responsibility and he should resign.
Kharsati said clause 6 (a) of the Sixth Schedule clearly states that elected members of the ADC shall hold office for a term of 5 years. When asked, the BJP leader said that the party would also conduct a follow up to ensure that the Amendment Act is declared as null and void.
